Kairalitrails LLP, bearing LLP Identification Number: ACG-5037, a Limited Liability Partnership incorporated under the Limited Liability Partnership Act 2008, (hereinafter, referred to as the “Kairalitrails”/ “Us” “We” or “Our”, which expression shall, unless repugnant to the context or meaning thereof be deemed to include its legal representatives, authorized personnel and permitted assigns). References to “you” and “your” in these terms and conditions (the “T&Cs”) means all persons named on your booking (including anyone who is added or substituted at a later date). Under these T&Cs, references to “Supplier” means the third-party supplier of the Services and references to us as the “agent” means the disclosed agent of the Services. When booking through us, you may be purchasing a “Package Holiday,” where the total price for your flight and accommodation is presented as an inclusive sum.
YOUR CONTRACT
1.1
We act solely as a facilitator in connection with your booking. Our role and obligations are strictly limited to those set forth in these Terms and Conditions (“T&Cs”). In the course of arranging your booking, we act exclusively as your disclosed agent for the purpose of securing a contract between you and the applicable supplier of the travel services, hospitality, and the origin service provider (the “Supplier”), and for coordinating the associated payment arrangements between you and the Supplier, as detailed in your Booking Confirmation.
1.2
Reservation of booking dates and time slots are strictly subject to availability at the time the reservation is made, it shall not be deemed confirmed until receipt of seventy percent (70%) of the total payment amount and issuance of the corresponding ticket(s). We make no representation or warranty that any Services advertised by us will be available at the time of your booking request.
1.3
To confirm your booking you must, make initial payment of 70% at the time of booking, the remaining 30% shall be paid 15 days prior to the departure. Alternatively, you may also make your payment in full including all applicable fees and charges at the time of confirming your booking with us. Your Booking Confirmation will set out the date(s) by which the payment of the balance is due.
1.4
Accommodation options cannot be pre-selected or reserved in advance. Any accommodation listed within the package shall be allocated subject to availability at the time of booking confirmation.
1.5
In case of cancellation, our Cancellation and Refund Policy will become applicable. If the trip is cancelled after the 70% deposit has been paid, then remaining 30% of the package cost must still be paid. Provided refund shall be as per the Cancellation and Refund Policy.
1.6
All published rates are indicative only and may be revised without prior notice in response to factors beyond the Company’s control, including, but not limited to, currency fluctuations, airfare adjustments, fuel surcharges, and changes to government taxes, levies, or duties.
1.7
Kindly be advised that upon confirmation, your booking shall be deemed final and irrevocable. No modifications, cancellations, or refunds shall be permitted thereafter under any circumstances.
1.8
As a disclosed agent under these T&Cs, we accept no responsibility for the acts or omissions of the Supplier or for the Services provided by the Supplier in relation to your single Service.
YOUR BOOKING
2.1
Please be advised that all bookings made via our website shall, by default, be construed as bookings for group travel arrangements, unless a private tour package is specifically selected and purchased under a separate agreement.
2.2
Only private tour bookings permit additional customizations, which may include, but are not limited to, the inclusion of supplementary destinations, extension of travel duration, and the accommodation of special requests, subject to availability and additional charges as applicable.
2.3
Any additional sightseeing excursions or use of transportation services beyond what is expressly stipulated in the confirmed itinerary shall incur supplementary charges, which shall be borne solely by the Client. The Company shall not be liable for any delays, cancellations, rescheduling, or other disruptions caused by airlines. All costs, losses, or damages arising from such events shall be the sole responsibility of the Client.
2.4
Kairalitrails shall not be liable for any modifications, amendments, or requirements resulting from changes in governmental laws, regulations, or policies.
2.5
No refunds, whether full or partial, shall be payable for any unused services, facilities, or inclusions. For more information refer to our Cancellation and Refund Policy. The Company reserves the right to amend or alter the itinerary at its sole discretion without prior notice due to operational needs, adverse weather, force majeure, or other circumstances beyond its reasonable control. Such modifications shall not entitle the Client to compensation or refund.
2.6
We shall not be liable for any airline-related delays, cancellations, rescheduling, or other disruptions, as such events are beyond its control, and any costs arising therefrom shall be borne solely by the customer. The customer is required to adhere strictly to the schedule specified in the itinerary, including timely reporting for airport transfers and tours. We disclaim all responsibility for any delays, missed transfers, or resultant consequences due to the customer’s failure to comply with the stated timings.
2.7
Please note that the standard check-in time is 15:00 hours, and the standard check-out time is 12:00 hours. Early check-in may be availed under the base package subject to availability and payment of an additional fee.
2.8
For guests under the premium package, early check-in is included as a complimentary benefit, subject to availability. Please note that accommodation preferences cannot be pre-selected or guaranteed in advance. Lodging will be allocated from among the options specified within the package, based strictly on availability at the time of booking confirmation.
2.9
You must check and fulfil the passport, health and immigration requirements applicable to your itinerary. You must ensure that your Passport is valid for at least six months and there should be at least three blank pages. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant embassies or consulates and your own doctor as applicable. You should attend required health checks and assessments with your doctor prior to travelling. Requirements change and you must keep yourself updated ahead of departure.
2.10
This T&C represents the entire agreement of the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous agreements and representations, written or oral (including without limitation, earlier version of this T&C that may have been accepted by you).
2.11
We reserve the right to modify this T&C at any time. Your continued use of any of the Kairalitrails services shall constitute and be deemed to be your acceptance of such modification and your consent to abide by any terms thereof.
2.12
This Agreement is an electronic record under the Information Technology Act, 2000 and applicable rules, and does not require any physical or digital signature. It is published in compliance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, requiring publication of the terms of use, privacy policy, and rules for accessing or using the website https://www.kairalitrails.com, including its mobile site and application (collectively, the “Platform”).
2.13
GOVERNING LAW
This Agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter shall be governed and interpreted in accordance with the laws of India in the state of Kerala. Each Party irrevocably agrees that the courts in Ernakulam shall have exclusive jurisdiction to settle any dispute or Claims. Parties irrevocably consents to the jurisdiction of such courts and waives all objections thereto.2.14
OWNERSHIP OF RIGHTS
All rights, including copyright, in this Website are owned by or licensed to Kairalitrails. Any use of this Website or its contents, including copying or storing it or them in whole or part, other than for Your own personal, non-commercial use is prohibited without the prior permission of Kairalitrails. You may not modify, distribute or re-post contents on this Website/App/chatbot for any purpose whatsoever.2.15
WARRANTIES AND DISCLAIMER
As a condition precedent to accessing and utilizing our Services, you hereby represent and warrant that all information and data furnished by you during the registration process, and at any time thereafter, shall be true, accurate, current, and complete to the best of your knowledge. You acknowledge and accept full responsibility for all actions, omissions, for any transactions undertaken through our website, relying on the information provided by you, whether authorized by you or not. Neither the Company nor any affiliated third party makes any express or implied representations, warranties, or guarantees regarding the accuracy, adequacy, or suitability of any information, content, or materials made available on the Website or via the Services. You expressly acknowledge and agree that such information and materials may contain inaccuracies, omissions, or errors, and to the maximum extent permitted by applicable law, we expressly disclaim and exclude any and all liability arising therefrom.You acknowledge and undertake that you are accessing the Services on the Website and application and transacting at your own risk and using your best and prudent judgment before placing an order or availing of the services or entering into any transactions with us through our Website. We shall not be held liable nor responsible for any representations or warranties/guarantees of the service save and except as explicitly provided under this T&C we hereby expressly disclaim all responsibility and liability in that regard
